Questions Every Toronto Renter Should Ask:

Renting in Toronto can be exciting, but it comes with responsibilities. Whether you’re moving for the first time or relocating across the city, understanding your rights ensures a safe, fair, and stress-free rental experience. This experience is a relationship between the landlord and tenant. The better each other understands their rights and obligations and communicates with one another, the more enjoyable the rental experience is.

What happens if my landlord sells the property?

With a valid lease, your landlord cannot evict you. The new owner must honor your lease at the same rent and terms. Month-to-month leases may require 60 days’ notice under specific circumstances. – For example, if the new owner wishes to move in to the property themselves.

Who is responsible for maintaining the unit?

Landlords are legally required to maintain the plumbing, heating, appliances, and structural integrity of the property. Tenants must keep the unit reasonably clean and refrain from causing damage.
Note: Tenants must be compensated monetarily for any external work example lawn cutting. This cannot be deducted from the rent.

 

Can I withhold rent if my landlord isn’t maintaining the property?

No. Instead, document concerns and communicate in writing. You may file a complaint with the Landlord and Tenant Board or the City of Toronto if issues persist.
Pro tip* Reach out to the real estate agent who helped you to assist in communication. A neutral third-party often saves a lot of aggravation.

What should I do if repairs are needed?

Notify your landlord in writing with details and photos. If unresolved, file a maintenance application (Form T6) with the Landlord and Tenant Board.

Who is responsible for smoke and carbon monoxide alarms?

Landlords are required to install and maintain alarms; tenants must never disable them and report any issues promptly. The landlord should be checking this every six months at least to confirm they are working correctly.

Can a landlord enter my unit — and when?

Landlords must provide 24-hour written notice for inspections, repairs, or showings (between 8:00 a.m. and 8:00 p.m.), except in emergency situations.

Can I refuse entry if my landlord wants to come in?

Only in cases where notice or purpose is invalid. Otherwise, lawful entry cannot be blocked. Repeated harassment may be reported.

The real estate agent leasing the property has provided me with a self-prepared lease agreement. Do I need to sign it?

No. This is either an inexperienced mistake or a sign that the agent is not fully informed. In Ontario, the only lease agreement you need to sign — and the only one recognized by law — is the Ontario Standard Lease Agreement. All legally valid clauses and terms are included in this document, and it is the only lease officially used and accepted by the Landlord and Tenant Board.
